Terms and
Conditions
1. Information
on how to enter and prizes form part of these Terms and Conditions.
Participation in this promotion is deemed acceptance of these terms and conditions.
2. The
promotion is open to enrolled University of Canterbury (“UoC”) students
aged 18 years and over. The University of Canterbury Student’s Association Student
Executive, employees and volunteers (and their immediate families) of the
Promoter and agencies/companies associated with the Promotion, as well as the employees
of Frucor Suntory NZ Limited (the “Prize Provider”) and their immediate
families, are ineligible to enter. Immediate family means any of the
following: spouse, ex-spouse, de-facto spouse, child or step-child (whether
natural or by adoption), parent, step-parent, grandparent, step-grandparent,
uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st
cousin.
- This
promotion will be run in association with participating stores. A
Participating Store is any UoC campus store which displays promotional
material advertising this promotion during the Promotional Period and may
include the following retail stores on the UoC campus: 1894,
Chilton's, Collective, Nuts & Bolts, Oishii, Otto, Foundry and
Undercroft Foodcourt (“Participating Stores”).
- Entries into the promotion commence on 19th
February 2024 and close on 11:59pm 31 May 2024 (“Promotional
Period”).
- To
enter the promotion, entrants must do each of the following during the
Promotional Period:
a. purchase any
two (2) V Energy products (“Participating Products”) in a single
transaction (“Qualifying Purchase”) from a Participating Store and while
stocks last;
b. fill out and
place a fully completed entry form (including full name, student I.D, address,
email address, contact number) into the open window of the Grand Prize Suzuki
Swift which will be located outside Chiltons’s (ground floor, James Hight
Building) or within a specially marked entry box at selected Participating
Stores where the Qualifying Purchase was made; and
c. ensure that
the completed entry form contains a stamp obtained by the employee of the
Participating Store to prove that the entrant made a valid Qualifying
Purchase. In the event that a stamp is not obtained at the time of making the
Qualifying Purchase, it is the entrant’s responsibility to request one.
6. Failure to obtain
the stamp which validates the form may result in invalidation of the entrant’s
entries and forfeiture of any right to the Grand Prize.
7. Multiple
entries are permitted, subject to the following:
a. only one (1)
entry is permitted per Qualifying Purchase;
b. each entry
must be submitted separately and in accordance with entry requirements set out
under clause 5; and
c. a maximum of
one (1) entries per person per day is permitted.
Grand
Prize
8. There
is one (1) grand prize to be won during the Promotional Period. The Grand
Prize consists of a 2020 Suzuki Swift Hybrid with automatic transmission,
including 12 months warrant of fitness and 1 months registration, an RRP of up
to $20,000 NZD (“Grand Prize”). The total Grand Prize pool RRP is
$20,000 NZD.
9. Grand
Prize conditions:
- The Grand
Prize must be picked up by the Grand Prize Contest winner at a date and
time to be determined by the Promoter.
b. The colour
of the Grand Prize vehicle is blue. The Promoter will remove any sign-writing
on the Grand Prize at its cost after the Promotional Period has finished.
c. Insurance,
petrol and all other ancillary costs are the responsibility of the Grand Prize
winner.
d. The Grand
Prize winner must hold a New Zealand Class 1 Restricted or Full drivers licence
or international equivalent to the New Zealand full drivers licence, in order
to claim the Grand Prize.
e. If the Grand
Prize winner is, through any legal incapacity or otherwise, unable to register
the car in their own name, then the winner may assign the car to another person
(who consents to such assignment) with legal capacity for the purpose of
registration. The Promoter takes no responsibility for any such arrangements
between the winner and the assignee. The winner must provide the Promoter with
certified copies of all required documentation as required by the Promoter
before the car is awarded. It is a condition of accepting the Grand Prize that
the winner may be required to sign a legal release in a form to be determined
by the Promoter in its discretion. The only warranty given by the Promoter or Prize
Provider with respect to the Grand Prize is that it is roadworthy when given to
the winner. No extended warranty is given.
- The Grand
Prize will have done approx. 10,500 kilometres when delivered to the
winner.
Entry into the Grand Prize Contest
10. The Promoter will draw
ten (10) entries by random prize draw from all valid entries collected over the
Promotional Period. The draw will take place on 3 June 2024 outside Chilton’s
(James Hight Building) at 12pm. The draw conductor may draw additional reserve
entries in case an invalid entry or entrant is drawn or an entrant is unable to
attend the Grand Prize Contest.
11. The first 10 valid
entries drawn will be randomly chosen to compete as contestants (Contestants)
in the Grand Prize Contest and will be notified on or before 4 June 2024. Contestants
must be available for the Grand Prize Contest to be held at The Foundry, 90
Ilam Road and ready to complete on 7 June 2024 at a time to be determined.
12. The Contestants will be
required to sign a waiver and medical release form which will be provided to
the Contestants and must be returned to the UCSA by 6 June 2024 (instructions
on how to return the forms will be provided at a later date). Failure to do so
will result in the Contestant not being permitted to participate in the Grand
Prize Contestant.
Rules of the Grand Prize Contest
13. The Grand Prize Contest
requires the Contestants to hold their hand constantly on the Grand Prize
except for allocated breaks and during other challenges held as part of the
Grand Prize Contest. The specific challenges will be determined, and rules of
the challenges explained to the Contestants, at the induction meeting on the
day of the Grand Prize Contest.
14. The specific rules of
the Grand Prize Contest include:
a. Contestants
must be available to attend the induction at The Foundry and ready to compete on
7 June at a time to be determined by the Promoter. If the Contestant is not
present, they will not be eligible to enter and will forfeit the ability to win
the Grand Prize.
b. The Grand
Prize Contest will be held outside and in any weather that is applicable on the
day.
c. The
Contestants will be positioned around the Grand Prize, at random, at the
Promoter’s sole discretion.
d. The
Contestant must always hold one bare hand on the Grand Prize in their allocated
position with this hand always being continuously in physical contact with the
Grand Prize (excluding sanctioned breaks and during the specific challenges).
If a Contestant’s hand does not maintain continuous physical contact with the
Grand Prize for any cause or reason whatsoever, that Contestant will be
disqualified. Physical contact means that the Contestant’s hand must be in
contact with the Grand Prize.
e. The last
Contestant whose hand is remaining in physical contact with the Grand Prize and
who has not been eliminated as part of the Grand Prize Contest challenges, will
win the Grand Prize.
f. The
Contestant cannot affix their hand to the Grand Prize in any way.
g. The
Contestant must stand at all times during the Grand Prize Contest.
h. Only
clothing to be worn by the Contestant and no items that the Promoter will
consider to be inappropriate.
i. The
Contestant will be given one 15 minute break every 4 hours or as otherwise
determined by the Promoter on the day of the Grand Prize Contest.
j. Each
Contestant will be responsible for acquiring their own food and beverages.
k. The
Contestant is not to leave the location of the Grand Prize Contest during the
break or they will be disqualified.
l. The
Contestant must return promptly to any position on the Grand Prize at the end
of each 15 minute break or challenge, or they will be disqualified.
m. The
Contestant may have the moral support of family or friends during the break.
n. The
Contestant will not harass or interfere with any other Contestant or they will
be disqualified.
o. No spectator
will harass or interfere with any other Contestant or they will be removed from
the location.
p. Only the
Promoter can disqualify a Contestant and the Promoter’s decision will be final
with no correspondence being entered into.
q. Any
Contestant who displays symptoms of being unwell, or is suffering any condition
that may impact their own health, or the health of other Contestants may for
health and/or safety reasons, following consultation with the Promoter or with
a health professional, the Contestant will be subject to disqualification.
r. Contestants
must keep themselves and their spaces clean, sanitary and orderly at all
times.
s. No visitors,
family, associates or supports are permitted inside the roped off area around
the Grand Prize and the Contestants.
t. Contestants
may not smoke, vape, or consume alcohol while competing. Illicit drugs will not
be permitted.
u. No
electronic devices including listening devices, reading, writing or drawing
material will be permitted at the location.
v. Any damage
to the Grand Prize or to the Promoter’s property by the Contestant will result
in disqualification.
w. All
decisions by the Promoter regarding the Grand Prize Contest including but not
limited to, winner selection, disposition of the Grand Prize, application and
interpretation of rules, resolution of any dispute, contest eligibility are
FINAL and not subject to appeal.
15. The Grand Prize is not
transferable, changeable or redeemable for cash. A winning Contestant is also
not able to transfer their ability to enter the Grand Prize Contest or redeem
their entry for cash.
16. The Grand Prize RRP is correct
as at the time of drafting these terms and conditions. The Promoter takes no responsibility
for any change to the RRP of any prize.
- In the event that
the Grand Prize becomes unavailable for any reason beyond the Promoter's
control, the Promoter may in its sole discretion decide to provide an
alternative prize.
18.
In the event that an ineligible
entry is drawn, or the Promoter is unable to contact the winning Contestant within
seven (7) days of first attempting to notify the Contestant, having made
reasonable attempts to do so, the Promoter may deem that Contestant’s entry
invalid and select a new Contestant on the same terms as the original entry.
19.
The winner is responsible for the collection of
the Grand Prize from UCSA Main Office at 90 Ilam Road. The Promoter is not
responsible for delivering the Grand Prize to the winner or any costs
associated with accepting or collecting the Grand Prize.
- Each
entrant may only win the chance to enter the Contest once. If an entrant
is drawn out of more than one draw associated with this promotion, the entry
will be forfeited and will be redrawn and a new Contestant will be
determined from the remaining valid entries.
- The
Grand Prize Contest will occur on 7 June2024 with the Grand Prize being
determined on this date (or at the end of the Grand Prize Contest).
- To the
extent permitted by law, the Promoter and Prize Provider take no
responsibility for any failure of any entry to be entered into the
promotion due to, without limitation, technical malfunction or human
error. The
Promoter and
Prize Provider are
not responsible for late, lost or misdirected entries.
- Except for any
liability that cannot be excluded by law, the Promoter and Prize Provider excludes
all liability (including negligence), for any personal injury or any loss
or damage (including loss of opportunity), whether direct, indirect,
special or consequential, arising in any way out of the Promotion,
including, but not limited to, where attributable to any of the following:
(a) any technical difficulties or equipment malfunction (whether or not
under the Promoter's control); (b) any theft, unauthorized access or third
party interference; (c) any entry or Grand Prize claim that is late, lost,
altered, damaged or misdirected; (d) any variation in the Grand Prize; (e)
any tax liability incurred by a claimant or entrant; or (f) use of the
Grand Prize.
- As a condition of
participating in the promotion, the winner indemnifies the Promoter, its
Agents, Prize Provider and all organisers, sponsors and all other persons
and organisations associated in any way with this promotion against all
claims, damages, liabilities, costs and expenses (including costs on a
solicitor-client basis) which the winner or Contestants may incur arising
out of their participation in the promotion and/or participating in the Grand
Prize Contest or use of the Grand Prize, howsoever caused.
- The Promoter’s decision, and the decision of its agents, is
final on all matters and no correspondence will be entered into.
- The Promoter reserves the right to amend, suspend or cancel
any aspect of this promotion (including any prize or term) at any time in
its sole discretion.
- Failure by the Promoter to enforce any of its rights at any
stage does not constitute a waiver of those rights.
- The Promoter reserves the right to disallow entries in its
absolute discretion and without giving reasons.
- The Promoter reserves the right to verify the validity of the
winner’s entry and disqualify any entry or refuse to award the Grand Prize
or a chance to enter the Grand Prize Contest where false or misleading
details have been given by an entrant or an entrant has behaved in a
fraudulent, dishonest or disruptive manner, or otherwise than in
accordance with these terms and conditions or the spirit of the promotion.
- Acceptance of the Grand Prize is deemed consent for the
Promoter and Prize Provider to use the winner’s details for promotional
and media purposes without compensation, and any copyright will vest in
the Promoter.
- The
Promoter collects and holds personal information provided by entrants for
the purposes of this Promotion and for future promotional purposes. For
the purposes of notifying the winners and facilitating redemption of a
prize, the Promoter and the Agency and Prize Provider may pass winners’
personal details to their agencies and other associated organisations.
Failure to provide requested personal information may disqualify a person
from entering the promotion or being able to receive a prize. All personal
information provided by entrants will be held by the Promoter. Under the
Privacy Act 2020, entrants have the right to access and correct any such
personal information. Entrants may access and request correction of any of
the details about them held by the Promoter by sending an email to hello@ucsa.org.nz.
